Mediation – Dispute resolution

In accordance with article L.612-1 of the French Consumer Code, “any consumer has the right to have recourse, free of charge, to a mediator with a view to the amicable resolution of a dispute between him or her and a professional”. To this end, the Tiara Miramar Beach Hôtel & Spa guarantees effective recourse to a consumer mediation system by adhering to the Médiation du Tourisme et du Voyage – MTV charter.

After contacting the hotel’s sales department and formulating a complaint in writing, in the absence of a satisfactory response or no response within 60 days, the customer may refer the matter to the mediator, whose contact details and procedures are available on his website: www.mtv.travel.

Terms and conditions of sale

Preamble

These general terms and conditions of sale apply to all bookings made on the website for a maximum of 4 rooms per booking.

The “customer” refers to any natural person making a reservation on the website on a private or professional basis (provided that the professional activity is not related to the hotel business).

The customer acknowledges having read all the necessary information on the nature, destination and booking terms of the services available on the website. If necessary, the customer will have requested the necessary services and received all additional information beforehand in order to make a reservation with full knowledge of the facts.

The customer acknowledges having reached the age of legal majority and being able to contract.

Any reservation made via the website implies full acceptance of the GTC.

Prices & photos

  • Prices for each reservation are given before and during booking in local currency. Prices shown are valid only for the type of room, number of people and date selected at the time of booking.
  • As the customer is a consumer, in accordance with article L. 121-20-4 of the French Consumer Code, the customer does not have the right of withdrawal provided for in article L. 121-20 of the French Consumer Code.
  • Cancellation and prepayment conditions vary according to the fare selected and the dates requested, and are stipulated at the time of booking.
  • A tourist tax of €4.02 is charged per night and per person.

All bookings must be confirmed by a deposit of at least 50% of the total cost of your stay.

In case of no-show, early departure or No show, 100% of the stay will be charged.

Deposits are non-refundable in the event of cancellation:

  • Less than 3 days before arrival date for low-season bookings (January to April and September to December)
  • Less than 7 days before arrival date for mid-season bookings (May to August)

Non-refundable fee :

  • Booking and cancellation conditions (NRF rate)
  • All bookings must be confirmed by a deposit of 100% of the total cost of the stay. In the event of cancellation, modification, no-show or early departure, the deposit is non-refundable.

VAT is calculated according to the legal rate on the day of booking. Rates may be subject to local taxes.

Reservations are payable in local currency. All foreign currency conversions are for information only.

All photos on the website are for information purposes only and are non-contractual. Every effort is made to make them as representative as possible.

Unless otherwise indicated, all other complementary services (breakfast, treatments, half-board, etc.) are not included in the prices.

The stay

Check-in : Rooms are available from 3:00 pm on the day of arrival. The villa is available to guests from 4:00 pm on the day of arrival.

Check-out : Unless otherwise agreed, guests must vacate their rooms by 11:00 a.m. on the day of departure. (Failing this, the hotel reserves the right to charge an additional night)..

In the event of unscheduled departure or interruption of stay, the hotel must be informed 24 hours before departure. The hotel reserves the right to charge 100% of the price of the stay.

In the event of a no-show (non-cancelled reservation, customer not present), the hotel reserves the right to charge 100% of the price of the stay to the card used as a guarantee at the time of booking.

The entire hotel is non-smoking.

Payment

Payment will be made at the time of booking via a secure payment link sent by email.

Cancellation policy for wellness treatments

For any modification or cancellation of a treatment by the customer, the hotel must be informed 24 hours in advance. After this time, or if the customer fails to show up, the treatment will be billed in full.

– Covered parking : 25€ per day

– Small pets: €30/night

For reasons of hygiene, pets are not allowed in the Spa and Restaurants.

Legal notice – Validity of gift vouchers

The gift vouchers offered for sale on the website of the Tiara Miramar Beach Resort, a 5-star hotel located in Théoule-sur-Mer, are issued by the resort’s operating company.

Period of validity

Each gift voucher is valid for twelve (12) months from the date of purchase, as shown on the electronic document given to the customer after payment.

At the end of this period, the voucher automatically expires and may not be reimbursed, extended or reactivated, except in the case of an exceptional, written commercial decision by management.

Terms of use

Gift vouchers are valid :

  • Gift vouchers are subject to availability at the hotel or restaurant concerned, and are valid upon prior reservation:
  • only for the service(s) indicated, or for their monetary equivalent in the establishment at the time of booking, if specified,
  • in Tiara Miramar Beach Resort establishments, including its food and beverage outlets, notably the Michelin-starred gourmet restaurant L’Or Bleu.

Some vouchers may be subject to date restrictions (public holidays, high season periods, special events), which will be specified at the time of booking

Non-refundable

Gift vouchers :

  • are neither refundable nor exchangeable for cash, even partially,
  • cannot be credited or carried forward after expiry,
  • are not transferable to a third party, unless otherwise stated or explicitly agreed by the establishment.

Loss, theft or fraud

In the event of loss, theft or fraudulent use, no duplicates or refunds will be made. It is the responsibility of the beneficiary to keep the voucher in a safe place.
